1. Acceptance of Terms
   onmap.pk offers a range of online services, including classified ads, forums, catalogs, and email services (referred to as “the Service”), subject to the following Terms of Use (“TOU”). By accessing or using the Service, you agree to adhere to the TOU. Additionally, when using specific services on onmap.pk, you agree to follow any applicable guidelines, which may change periodically. If you disagree with any terms, conditions, or modifications to the TOU, your only option is to discontinue using the Service.
2. Changes to Terms
   We may, at any time, modify these terms and conditions at our sole discretion. These changes will be effective immediately upon being posted. Regularly reviewing this agreement is your responsibility to stay informed of any updates.
3. Eligibility for Use
   onmap.pk reserves parts of its Service for professional buyers, sellers, collectors, and resellers who meet the platform’s criteria. While onmap.pk aims to restrict these sections to qualified users, it does not guarantee or assume responsibility for screening all users. Therefore, no legal action can be taken against onmap.pk for the participation of unqualified users.
4. Content
   You acknowledge that all content posted or shared on the Service, such as ads, messages, images, and more, is the responsibility of the person who uploaded it. If you request onmap.pk to post content or imply consent for onmap.pk to share it on your behalf, you remain responsible for that content. By uploading content, you grant onmap.pk a worldwide, non-exclusive, and perpetual license to use, reproduce, and distribute it as needed. Furthermore, onmap.pk is not responsible for the accuracy or appropriateness of external links. Any reliance on content shared via the Service is solely at your own risk.
5. Third-Party Content, Sites, and Services
   onmap.pk may contain links to third-party content or websites that are independent of onmap.pk. Your interactions with these third parties, including transactions, payments, and warranties, are entirely between you and the external party. onmap.pk assumes no responsibility for any disputes, damages, or losses resulting from these interactions, and you release onmap.pk from any claims arising out of such situations.

6. Notification of Copyright Infringement
   If you believe your copyrighted work has been misused or your intellectual property rights violated on onmap.pk, please notify us at notice@onmap.pk. Include details like the infringing material, your contact information, and a declaration under penalty of perjury that you own the rights in question or are authorized to act on behalf of the owner.
7. Privacy and Disclosure
   onmap.pk may disclose or retain your content and personal information (such as email addresses and IP addresses) in accordance with our Privacy Policy.
8. User Conduct
   You agree not to post content that is unlawful, harmful, defamatory, pornographic, discriminatory, or violates intellectual property rights. Prohibited actions also include impersonating others, posting false or misleading content, sending spam, or disrupting services. Automated methods of posting are also not allowed without explicit permission.
9. Posting Agents
   Posting content on behalf of others through third-party agents is not allowed unless explicitly permitted by onmap.pk.
10. No Spam Policy
    Sending unsolicited email advertisements via onmap.pk’s systems is strictly prohibited. Violations may lead to civil and criminal penalties, including under the Computer Fraud and Abuse Act.

11. Paid Postings
    We may charge a fee for posting content in specific areas of onmap.pk. Please note that all fees are non-refundable if your content is removed for violating the TOU. Fees for subscription services and advertising are also non-refundable, unless otherwise specified in a written promotional program.
12. Service Limitations
    You acknowledge that onmap.pk may impose limitations on the use of its services. These may include restrictions on the number and size of posts, the storage duration of content, or the frequency of service access. We are not responsible for any deletion or failure to store content. Additionally, onmap.pk reserves the right to modify or discontinue the service at any time without notice. We are not liable for any such changes or disruptions.
13. Access to the Service
    onmap.pk grants a limited, revocable license for personal use of its services. This does not include access by third-party posting agents or the use of automated tools like data mining or web crawlers without explicit permission. You may link to our homepage, but not to individual postings without authorization. Use of our RSS feeds is permitted for personal, non-commercial purposes, with proper attribution, but may be discontinued by onmap.pk at any time.
14. Termination of Service
    onmap.pk reserves the right to deactivate accounts, block access, or remove content at its discretion if the TOU is violated. We are not liable for any termination of service, and users are prohibited from attempting to access the service after termination. Certain sections of the TOU will remain in effect even after termination.
15. Proprietary Rights
    The content on onmap.pk is protected by copyright and international treaties. Users are prohibited from reproducing, modifying, or distributing content without express written consent. While users retain ownership of their posted content, by posting, they grant onmap.pk a non-exclusive, perpetual license to use, display, and distribute the content. This includes the right to prevent unauthorized use by third parties.

No advice or information, whether verbal or written, obtained from onmap.pk or through its services, shall create any warranty not expressly stated here. Please be aware that some jurisdictions do not permit the disclaimer of implied warranties, and thus some of the aforementioned disclaimers may not apply to you.

17. Limitations of Liability

Under no circumstances shall onmap.pk be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of onmap.pk or its services. This limitation applies regardless of the cause of action, including any misuse of onmap.pk or its services, inability to use them, or interruptions, suspensions, modifications, or terminations of the services. These limitations also apply to damages incurred through other services or products accessed via onmap.pk or related links. These limitations are enforceable to the fullest extent allowed by law. In jurisdictions where liability limitations are not permissible, some of the above limitations may not apply.

18. Indemnity

You agree to indemnify and hold harmless onmap.pk, its officers, subsidiaries, affiliates, successors, assigns, directors, agents, service providers, suppliers, and employees from any claims or demands, including reasonable attorney fees and court costs, made by any third party arising from content you submit, your use of the service, any violations of these Terms of Use, breaches of your representations and warranties, or infringements on the rights of others.

19. General Information

These Terms of Use (TOU) and any additional terms to which you agree when using specific elements of the service represent the complete agreement between you and onmap.pk, superseding any prior agreements. The failure of onmap.pk to exercise or enforce any right or provision of the TOU does not constitute a waiver. Should any provision be deemed invalid by a competent court, the remaining provisions will continue in full force and effect. You agree that any claims or causes of action arising from your use of the service or the TOU must be filed within one year from the date they arise or be forever barred.

20. Violation of Terms and Liquidated Damages

To report any violations of the TOU, please email notice@onmap.pk. Our inaction regarding a breach by you or others does not waive our right to address subsequent breaches. You understand and agree that damages may be challenging to quantify, and if legal action is necessary to enforce the TOU, you will be liable for the following liquidated damages, which are reasonable estimates of onmap.pk’s damages for specific breaches:

• If you post a message that impersonates any person or entity, falsely represents your affiliation, or includes personal information about another individual without consent, you agree to pay onmap.pk $1,000 for each such message. This does not apply to lawful, non-deceptive parodies of public figures.
• If we limit your access to the service or terminate your access, you agree to pay onmap.pk $100 for each message posted in excess of such limits or for each day of excessive access, whichever is greater.
• For unsolicited email advertisements sent to onmap.pk, you agree to pay $25 for each email.
• If you post content in violation of the TOU, you agree to pay onmap.pk $100 for each item of content.
• Posting Agents violating the TOU will pay $100 for each item of content posted in violation, and the Principal engaging the Posting Agent agrees to pay the same amount for violations committed on their behalf.
• If you exploit any content in violation of the TOU without express written permission from onmap.pk, you agree to pay $3,000 for each day of such conduct.

22. Terms of Use for All Services

Onmap.pk provides various online programs (the “Programs”) for the convenience of participating professionals and consumers interested in engaging these professionals for services (“Services”) or information related to such Services.

By using the Programs, you acknowledge and agree to the following:

• Use at Your Own Risk: The Programs are utilized at your own risk. Onmap.pk and its affiliates disclaim all warranties, whether express or implied, related to:

For Consumers:

• • The Programs
  • The Professionals
  • The Services performed by any Professional

Additionally, this includes:

• • Your engagement of any Professional
  • Actions, negligence, or conduct by you or any Professional’s agents
  • Other matters related to the Programs
• Limitation of Liability: Onmap.pk’s liability to you is capped at a maximum of $25.00.
• No Provider of Services: Onmap.pk and its affiliates do not provide services to you nor are they a party to any agreement you may establish with a Professional. Any arrangements with Professionals are solely between you and the respective Professional.
• Validity of Terms: If any part of these Terms of Use is found invalid by a competent court, the remaining provisions will remain effective.

For Professionals:

• Liability Disclaimer: Onmap.pk and its affiliates are not liable for any damages resulting from your use of the Programs, engagement by any Consumer, or any conduct of you or the Consumer’s agents.
• Limitation of Liability: Similar to Consumers, onmap.pk’s liability to you is capped at $25.
• Non-Party to Agreements: Onmap.pk and its affiliates do not engage in any agreement between you and the Consumer. All arrangements are strictly between you and the Consumer.
• Validity of Terms: The invalidity of any portion of these Terms of Use does not affect the enforceability of the remaining provisions.

23. Brand Agreement

Legal Disclaimer: By logging into your onmap.pk account, you confirm your authority to represent the manufacturer’s products, pricing, and copyrighted material online. If you disagree with these terms or lack the legal right to represent the brand, please refrain from logging in.

1. Parties: This “Agreement” is between “I,” “me,” or “the Company” and onmap.pk. This Agreement governs our relationship and allows for electronic transaction creation.
2. Content Licensing: You grant onmap.pk permission to use images (including logos, products, installation photos), product catalogs, and related data (collectively, the “Content”) that you provide. This Content may be displayed on onmap.pk and affiliated sites, including social media and promotional materials. While you may suggest how to showcase your products, onmap.pk retains full discretion over Content display.
3. Fees:
   • Membership Costs: Membership prices are as stated on onmap.pk at the time of purchase. These prices remain valid as long as your membership is current. All payments are due upfront at the start of each billing cycle (30 days or 365 days) and will be automatically deducted unless you cancel.
4. Contract Duration: This Agreement remains effective until you cancel your account.
5. Billing Policy: If payment is due for your Membership and your credit card is invalid, onmap.pk may contact you for updated information and will wait 30 days before canceling your membership.
6. Termination Policy: You may terminate this Agreement at any time, effective at the end of your billing cycle. Onmap.pk may terminate this Agreement at will. If onmap.pk terminates early without a violation on your part, you will receive a prorated reimbursement for the remaining billing cycle.
